Cancellations: All cancellations must be in writing. Since cancellation terms are specific to each individual trip or group departure, please refer to the brochure for your trip for detailed information. 여행의 취소는 서면으로 해야 합니다. 취소 조건은 개별 여행이나 단체 출발별로 다르므로 여행 안내문을 참조하여 자세한 내용을 확인하십시오.
Refunds: Subject to the foregoing Cancellation Terms, upon cancellation of travel-related services, all sums paid to Angel Tour for such services will be promptly returned to the customer, provided the customer has not caused such cancellation and is not in violation of any of the terms and conditions previously, clearly and conspicuously disclosed and agreed to by the customer. This refund provision does not apply where Angel Tour has remitted the payment to another registered seller of travel or a carrier and they default in providing the agreed‐upon transportation or service without providing a refund. In such a situation, Angel Tour agrees to provide the customer with a written statement accompanied by a copy of the bank records establishing the disbursement of the payment, and if disbursed to a seller of travel, proof of their current registration. 상기 취소 조건에 따라, 고객이 여행관련 서비스를 취소하면, 고객이 그러한 취소를 유발하지 않았으며 고객이 명확히 이해하고 동의한 약관사항을 위반하지 않는 한, 해당 서비스에 대해 엔젤투어에 지불한 모든 금액은 즉시 고객에게 환불됩니다. 이 환불 조항은 엔젤투어가 다른 여행사 또는 운송업자에게 고객들의 운송이나 현지서비스 제공을 목적으로 이미 송금한 경우에는 적용되지 않습니다. 이 경우 엔젤투어는 송금을 확인할 수 있는 은행 기록 사본과 함께 고객에게 서면 진술서를 제공하는 것에 동의합니다.
Trust Account Disclosure: California law requires certain sellers of travel to have a trust account or bond. Angel Tour has such a trust account.캘리포니아 법은 여행업체에 신탁계좌나 채권을 갖도록 요구합니다. 엔젤투어는 Trust Account를 가지고 있습니다.
Travel Consumer Restitution Corporation (“TCRC”): AngelTour is a participant in the Travel Consumer Restitution Corporation (“TCRC”). You, the customer, may request reimbursement from TCRC if the Seller of Travel was registered and participating in the TCRC at the time of sale and the customer is located in California at the time of payment. Please be advised that customers purchasing from outside of California are not covered by the TCRC. Eligible customers may file a claim with TCRC if the customer is owed a refund of more than $50 for transportation or travel services which the Seller of travel failed to forward to a proper provider or if such money was not refunded to you when required. The maximum amount which may be paid by the TCRC to any one customer is the total amount paid on behalf of the customer to the Seller of Travel, not to exceed $15,000. A claim must be submitted to the TCRC within six months after the scheduled completion date of the travel. A claim must include sufficient information and documentation to prove your claim and a $35 processing fee. You must agree to waive your right to other civil remedies against a registered participating Seller of Travel for matters arising out of a sale for which you file a claim with the TCRC if you were located in California at the time of the sale. You may request a claim form by writing to Travel Consumer Restitution Corporation, P.O. Travel Documents: A passport that is valid for a minimum of 6 months past the date of your return flight home is required of all U.S. citizens. Visas may be required of U.S. citizens depending upon the countries you will be visiting and if a visa is required it will be indicated on the brochure for your trip. If you are not a U. S. citizen, please call to determine your visa requirement status. Travel Risks: Although most travel to international destinations is completed without incident, travel to certain areas may involve greater risk than others. You assume sole responsibility for your own safety at any destination traveled to. Angel Tour does not guarantee your safety at any time and assumes no responsibility for gathering and/or disseminating information for you relating to risks associated with your destinations.대부분의 해외여행은 사고없이 완료되지만 특정 지역으로 여행하는 경우 다른 지역보다 더 큰 위험이 따를 수 있습니다. 여행 목적지에서의 자신의 안전에 대한 판단은 전적으로 귀하의 책임입니다. 엔젤투어는 귀하의 안전을 보장하지 않으며 목적지와 관련된 위험과 관련된 정보를 수집 또는 배포 할 책임이 없습니다.
Tour Cost: All quoted prices are based upon airfares, tariffs, and currency exchange rates at the time of reservation and are subject to change at any time. Should the minimum number of tour members not be reached, the right is reserved to increase the tour cost accordingly. 모든 여행비용은 예약 당시의 항공료, 관세, 환율에 근거하고 있으며 언제든지 변경될 수 있습니다. 최소 인원수에 도달하지 못할 경우엔 비용이 증가하게 됩니다.
Baggage: On group tours, each customer is allowed one checked bag and one carry‐on. You will be responsible for paying to the airline any additional charges for additional checked baggage or overweight baggage (if excess weight is permitted). Angel Tour is not responsible for lost, damaged or stolen baggage. 단체 여행에서는 각 승객에게 위탁 수하물 1 개와 캐리온 백 기내 반입이 허용됩니다. 추가 위탁 수하물 또는 중량 초과 수하물에 대해서는 추가 요금 (항공 중량이 허용 된 경우)을 항공사에 지불해야 할 책임이 있습니다. 엔젤투어는 수하물 분실, 손상 또는 도난에 대해 책임지지 않습니다.
Air Transportation: All airfares, airline taxes, and airline fuel surcharges are based upon levels in effect at the time of printing of the brochure for your trip or your original trip quotation and are subject to change until the time of ticketing. Flight schedules are subject to change without notice. 모든 항공료, 세금 및 항공사 유류 할증료는 여행 견적시 적용되는 수준을 기준으로하며 발권 시점에 변경 될 수 있습니다. 비행 스케줄 또한 예고없이 변경 될 수 있습니다.
Travel Insurance: Angel Tour is insured for travel Insurance. However, we strongly recommend that you have comprehensive travel insurance. Travel insurance should be purchased directly by each individual through an insurance company. 엔젤투어는 여행보증보험에 가입되어 있지만 각 개인도 여행시 종합여행보험에 가입할 것을 강력히 추천합니다. 여행자보험은 각 개인이 보험사를 통해 직접 구매하여야 합니다.
Travelers with special needs or disabilities: Angel Tour makes no guarantee as to the ability of any accommodations, activity provider, or facilities advertised on its site to meet the special needs of disabled clients. If you have special needs (e.g., wheelchair accessible room, traveling with seeing eye dog, etc.) you must call ahead of time and verify that special needs can be met. Depending on the terms and conditions and our travel provider, and their abilities to accommodate those needs, your reservation may be refunded, canceled or modified if those special needs cannot be met. We have no special knowledge regarding the suitability for disabled persons of any portion of any tour or activity offered.엔젤투어는 장애가 있는 고객들의 특별한 요구를 충족시키기 위해 숙박시설, 활동 제공업체 또는 시설들의 능력에 대해 보증하지 않습니다. 특별한 요구사항이 있을 경우(예: 휠체어 접근 가능한 방, 안내견과 함께 여행하는 등) 본인이 미리 전화를 걸어 특별한 요구사항이 충족될 수 있는지 확인해야 합니다. 약관 및 여행사, 그리고 그 필요를 수용할 수 있는 능력에 따라, 만약 그러한 특별한 요구가 충족되지 않는다면, 해당 고객의 예약은 환불되거나 취소되거나 수정될 수 있습니다. 우리는 제공되는 여행이나 활동의 어떤 부분에 있어서 장애인들의 적합성에 대해 특별한 지식이 없습니다.
Responsibility Clause: Additional expenses incurred as a result of a flight delay, change of schedules, illness, weather, strikes, hostilities, quarantine, government requisition of hotel space or any other reasons beyond the control of the tour operator or travel agent shall be borne by the customer. Angel Tour reserves the right to substitute hotels of similar category if necessary and to alter itineraries. Your deposit certifies that you agree with the above terms and conditions.항공기 지연, 일정 변경, 질병, 날씨, 파업, 적대 행위, 검역소, 호텔 공간에 대한 정부 요청 등 여행사 또는 여행 에이전트가 통제 할 수 없는 기타 사유로 인해 발생하는 추가 비용은 고객이 부담합니다. 엔젤투어는 필요한 경우 유사한 카테고리의 호텔을 대체하고 여정을 변경할 권리를 보유합니다. 귀하의 디파짓은 위의 이용 약관에 동의함을 증명합니다.
Limitation of liability: The airlines, hotels, and other suppliers (jointly: “travel suppliers”) providing travel or other services sold by Angel Tour are independent contractors and not agents or employees of Angel Tour. Angel Tour and/or their cooperating selling agents and/or their travel suppliers offer these tours for sale only on the express understanding that they themselves do not perform or in any way assume liability for the performance of the individual components, transfers, hotels, flights, car, motor coaches, etc. of these tours and act only to combine these components into a single unit of sale for the convenience of the tour customers. To the extent permitted by law, Angel Tour does not assume liability for any injury, damage, death, loss, accident or delay due to an act or omission of a travel supplier, including, without limitation, an act of negligence or the default of a travel supplier. To the extent permitted by law, no responsibilities are accepted for any damage and/or delay due to force majeure, sickness, pilferage, labor disputes, bankruptcy, machinery breakdown, quarantine, government restraints, weather, terrorism or any causes beyond Angel Tour’ control. Further, no responsibility is accepted for any additional expense, omissions, delays, failure to make connections, non‐performance or poor performance, loss of revenue, loss of anticipated profits, any additional expenses or lost business, attributable to you yourself, acts or omissions of any third parties, or acts of any governmental authority, even if Angel Tour has been advised that such damages were possible or probable. 엔젤투어에서 판매하는 여행 또는 기타 서비스를 제공하는 항공사, 호텔 및 기타 공급 업체 (공동 여행 업체)는 독립 계약자이며 엔젤투어의 대리인 또는 직원이 아닙니다. 엔젤투어 및 / 또는 협력사 및 / 또는 타 여행사는 해당 여행의 각 구성 요소인 운송, 호텔, 항공편, 자동차, 코치 등을 고객들의 편의를 위해 단일 판매 단위로 결합하는 역할만 합니다.
법률이 허용하는 범위 내에서, 엔젤투어는 타 여행공급자의 파산 또는 태만행위 또는 누락으로 인한 고객의 부상, 손상, 사망, 손실, 사고 또는 지연에 대해서는 책임을 지지 않습니다. 법에 의해 허용되는 범위 내에서, 불가항력, 질병, 도둑질, 노동 쟁의, 파산, 기계 고장, 격리, 정부 억제, 날씨, 테러 또는 엔젤투어가 통제할 수 없는 원인에 의한 어떠한 손상 및/또는 지연에 대해서도 책임이 없습니다. 또한 추가 비용, 누락, 지연, 연결 실패, 성능 저하, 수익 손실, 예상 이익 손실, 자신에게 귀속되는 추가 비용 또는 손실, 제3자의 행동 또는 누락 또는 정부 권한의 행사에 따른 어떠한 책임도 인정되지 않습니다. 비록 엔젤투어가 그러한 피해의 가능성이 있거나 그럴 가능성이 있다는 조언을 받았다 하더라도 말입니다.
Severability: If any provision of this agreement shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions.본 계약의 조항이 불법, 무효 또는 어떤 이유로든 집행 불가능한 경우, 해당 조항은 본 계약에서 분리될 수 있는 것으로 간주되며, 나머지 조항의 유효성과 집행 가능성에 영향을 미치지 않습니다.
Disputes: Mandatory Binding Arbitration, Governing Law, Jurisdiction, Etc.: These Terms and Conditions and the relationship between all passengers and Angel Tour will be governed by the laws of the State of California without regard to its conflict of law provisions. Any dispute concerning, relating, or referring to these Terms and Conditions, Angel Tour Privacy Policy, Angel Tour website or any literature or materials concerning Angel Tour shall be resolved exclusively by binding arbitration held in Orange County, California and presided over by one arbiter from JAMS or another similar organization which specializes in the mediation and arbitration of disputes. The arbitrator’s decision shall be final and binding and judgment may be entered thereon. In the event, a party fails to proceed with arbitration the other party is entitled to costs of suit including a reasonable attorney’s fee for having to compel arbitration. Nothing herein will be construed to prevent any party’s use of injunction, and/or any other prejudgment or provisional action or remedy. Any such action or remedy shall act as a waiver of the moving party’s right to compel arbitration of any dispute. 본 이용 약관과 모든 고객과 엔젤투어간의 관계는 법 조항의 충돌과 상관없이 캘리포니아 주법의 적용을 받습니다. 본 이용 약관, 엔젤투어 개인 정보 보호 정책, 엔젤투어 웹사이트 또는 엔젤투어 관련 문서 또는 자료와 관련된 분쟁 또는 관련 내용은 캘리포니아주 오렌지 카운티에서 개최되고 JAMS의 한 중재자 또는 중재를 전문으로 하는 다른 유사한 조직의 구속력있는 중재에 의해 독점적으로 해결됩니다. 중재인의 결정은 최종적이며 구속력이 있으며 판결이 내려 질 수 있습니다. 당사자가 중재를 진행하지 못하는 경우 상대방은 중재를 강제해야 하는 합리적인 변호사 비용을 포함한 소송 비용을 받을 권리가 있습니다. 이 문서의 어떤 부분도 당사자의 금지 명령 및 / 또는 다른 사전 판단 또는 잠정 조치 또는 구제 수단을 사용하지 못하도록 해석되지 않습니다. 그러한 조치 또는 구제책은 분쟁의 중재를 강요 할 수 있는 당사자의 권리 포기로 작용합니다.
Customer and Angel Tour agree to irrevocably submit to the personal jurisdiction of the federal and state courts located in Orange County with respect to any legal proceedings that may arise in connection with, or relate to, these Terms and Conditions, and not to assert, by way of motion, as a defense or otherwise, in any such action, suit or proceeding, any claim that (i) he, she or it is not subject personally to the jurisdiction of such court, (ii) the venue is improper, or (iii) this agreement or the subject matter hereof may not be enforced in or by such court. You recognize and agree that, by submitting your deposit to Angel Tour, you and Angel Tour are each waiving the right to a trial by jury or to participate in a class action with respect to the claims covered by this mandatory binding arbitration provision. 고객과 엔젤투어는 본 약관과 관련하여 발생하거나 관련될 수 있는 모든 법적 절차에 관하여 캘리포니아주 오렌지 카운티에 위치한 연방 및 주 법원의 개인 관할권에 영구히 제출하는 데 동의하며, 동의에 의한, 변호 또는 기타 방법으로 주장하지 않습니다. 이러한 조치, 소송 또는 소송, 절차, (i) 개인적으로 그러한 법원의 관할에 해당되지 않는다는 주장, (ii) 장소는 부적절하거나, (iii) 본 계약 또는 본 계약의 대상이 해당 법정에서 또는 해당 법정에서 강제되지 않을 수 있습니다. 디파짓을 엔젤투어 제출함으로써, 귀하와 엔젤투어는 각각 배심원의 재판권을 포기하거나 이 의무적 구속적 중재조항에 의해 적용되는 주장과 관련하여 집단행동에 참여한다는 것을 알고 동의합니다.
The failure of Angel Tour to act with respect to a breach of these Terms and Conditions by you, or others, does not waive its right to act with respect to subsequent or similar breaches. Angel Tour does not guarantee it will take action against all breaches of these Terms and Conditions. 엔젤투어가 귀하 또는 다른 사람이 본 이용 약관 위반과 관련하여 행동하지 않았다고해서 후속 또는 유사한 위반에 대해 행동 할 권리를 포기한 것은 아닙니다. 엔젤투어는 본 이용 약관의 모든 위반에 대해 조치를 취한다고 보장하지도 않습니다
Acceptance: It is the duty of the purchaser to inform all customers of all relevant terms and conditions stated herein. Submission of a deposit by purchaser certifies acknowledgment and acceptance of all listed terms and conditions and certifies that all customers have been informed of the relevant terms and conditions and they have acknowledged and accepted them as well. 여기에 명시된 모든 관련 약관을 올바로 아는 것은 고객 의무입니다. 여행 계약금 지불은 열거된 모든 약관에 대한 인정과 수락을 의미하며, 마찬가지로 모든 고객들이 관련 약관이 전달되었다는 것을 인정하고 받아들였다는 것을 의미합니다.
